Montgomery County and Norristown Second DUI Offense Attorney
Statistics show that approximately one in three people arrested for drunk driving has had a prior DUI arrest. Pennsylvania lawmakers are aware of this and continue to push for even harsher penalties for those convicted of repeat DUI.
Look-Back Period of 10 Years and Stiff Penalties on Conviction
Previous DUI laws in Pennsylvania had a "look-back period" of seven years. Look-back periods refer to how long a DUI conviction or ARD disposition will be considered a prior offense.
Now the look-back period is 10 years, which means that any DUI conviction or ARD disposition you have had within the past 10 years:
- Will be considered a prior DUI offense
- Will be taken into account as prosecutors determine what charges to file and what penalties to seek against you
If you are convicted on a repeat or subsequent DUI charge, you will receive a sentence that includes jail time, steep fines, a loss of license and other negative consequences.
Skilled Lawyer Can Make a Difference in Your Case
My name is Henry Hilles, and I am a former Montgomery County criminal prosecutor who now focuses on defending people like you — good people caught in bad situations that could affect them for the rest of their lives. I defend clients, including out-of-state drivers, underage drinkers and others, against misdemeanor DUI or felony DUI charges in Pennsylvania.
When you are facing the potential penalties associated with a second or third DUI, it is critical to hire an attorney who understands the law and who will dedicate the time and resources to fight the case aggressively. From analyzing the initial cause for the traffic stop to examining the validity of the blood alcohol concentration testing equipment, I comb through the evidence and prepare the strongest defense possible on your behalf.
I use my experience as a prosecutor to review your case through a prosecutor's lens. Knowing how prosecutors build cases helps me build a strong defense and anticipate and overcome obstacles.

Ignition Interlock Device
If you are convicted of a repeat DUI, whether it was your second or a multiple DUI offense, you will be required to install an ignition interlock device in the vehicle you regularly drive. This interlock device must be installed for at least one year after your license suspension period ends and prior to applying for an unrestricted driver's license. Additionally, you must pay rent for the device. If you do not comply with ignition interlock rules or you tamper with the device, you can experience additional charges and even harsher penalties.
