ARD Benefits — A One Fresh-Start Pass
ARD is a pretrial intervention program that is designed to divert first-time offenders from the criminal justice process. Generally, first-time offenders are eligible for the program. If you have been arrested for drunk driving with a child under 14, you are not eligible for the ARD program. ARD is basically a one-time chance to keep your criminal record clean. Other benefits include:
- No jail time — While most DUI first time offenders must spend time in jail, ARD participants avoid it altogether.
- Minimal license suspension — Under Pennsylvania law, license suspension in the ARD program ranges from zero to 12 months. Although some license suspension is sometimes unavoidable, ARD sometimes results in a license suspension of just one month.
- Possible record expungement. Following the fulfillment of ARD requirements, it's often possible to have your record cleared. This does not happen automatically, and you will still have a criminal record. However, no one will have access to your records or to the fact that you were arrested on suspicion of DUI.
